  • When does the trustee mail the disbursement checks?

    The trustee’s office usually generates disbursement checks on the third Thursday of the month. After a review has been done to determine that all information is correct, orders issued by the court have been received and entered, and disbursements may be sent, the checks are mailed. Generally, disbursement checks are mailed the same day in which they were generated.

    Can I receive my payment electronically rather than by check?

    Any creditor who desires to receive payments from the Trustee by Electronic Funds Transfer (EFT) must fill out and send to the Trustee the Authorization and Agreement for Electronic Payments form. This form may be obtained by e-mailing your request to ch13plano@ch13plano.com.

  • I want to file a claim. Where do I get the form and what do I do with it?

    The Bankruptcy Court allows creditors to use Electronic Proof of Claim filing known as ePOC to create, file, amend or withdraw a Proof of Claim using the ePOC system. For more information on this system, please click here.

    Creditors may also use Official Claim Form B410. The official claim forms may be found on the United States Bankruptcy Court Eastern District of Texas website.

  • Will I receive interest on my claim?

    The Chapter 13 plan and order confirming the Chapter 13 plan determine whether or not interest will be paid on a claim. If interest is to be paid, these documents also indicate the rate of interest that will be paid. If no interest is specified in the plan or order confirming plan, no interest will be paid. The interest rate listed on the proof of claim form will not be binding with respect to the rate of interest paid.

  • I need to update my address. How do I go about doing that?

    In order for the trustee’s office to update its records, a Change of Address form must be completed and filed with the court. The form can be found on the United States Bankruptcy Court Eastern District of Texas website. It should be filled out and returned directly to the court for processing.   • I need to file a modified plan but do not know what plan payments the debtor has made to date or what the Trustee has paid to creditors. What can I do?

    In order to effectively file a modified plan, the debtor’s attorney must review the plan payments received by the trustee, as well as disbursements made to creditors. This information is available on 13Network. Please contact the trustee’s office to set up access to 13Network.

  • How do I access case information?

    Case information can be accessed through the National Data Center website provided that you comply with their requirements.

    Case information may also be obtained through the 13Network website provided that you sign an agreement with the trustee’s office regarding the use of the data. This agreement is necessary for access to the Trustee’s website on www.13network.com. Creditor access is limited to cases with claims or notices of appearance on file. Creditor attorney access is also limited to cases in which the attorney represents a creditor. Please e-mail our office at ch13plano@ch13plano.com to obtain the necessary forms.

  • Unclaimed funds are monies deposited with the court by the Trustee pursuant to §347, Title 11 of the United States Code. Generally, these monies are unclaimed because the Trustee does not have a current address for the creditor. Funds may be claimed pursuant to §2042, Title 28 of the United States Code.     You must file an Application to obtain any unclaimed funds. A link to the appropriate form is provided here.

    The Trustee cannot obtain funds for a party once they are deposited with the Court. Only the Clerk of Court can issue a check upon the Court’s approval of the Application.
